These Terms apply when you use tcg-bay.com or buy credits or a subscription from us. We tried to write them in plain English. If something is unclear, email us — the address is at the bottom.

Who you're contracting with

What you're buying

tcg-bay sells credits that let you identify and grade Pokémon cards from photos. The economy is simple:

  • 1 credit identifies 1 card (covers candidate suggestions, AI condition + centering hint, printing match).
  • 10 credits performs a Pregrade scan on 1 card (per-corner / edge / surface / centering subgrades on a 1–10 scale, plus a Poor → Gem Mint label).
  • A photo with multiple cards charges the per-card cost for each detected card.

You can buy credits two ways:

  • Subscription — monthly or yearly. You receive a credit allowance each billing period; unused credits roll over up to the cap stated on the pricing page. Anything above the cap is dropped at the next renewal.
  • Packs — one-off purchases (100 / 500 / 2,500 / 10,000 credits). Pack credits never expire and stack on top of subscription credits. Subscription credits are spent first.

Prices, VAT, and payment

All prices are in EUR and include any applicable VAT under Belgian consumer law — the number you see is the number you pay. Payments are processed by Stripe. We never see or store your card details; Stripe handles them directly under PCI-DSS Level 1 compliance.

Subscriptions renew automatically at the end of each billing period using the payment method on file. You can cancel at any time from account billing and your remaining credits stay usable until they expire under the cap rules above.

Delivery

Credits are delivered instantly after Stripe confirms the payment (usually within a few seconds). For subscriptions, your allowance is granted at the moment the subscription starts and again at each successful renewal.

Right of withdrawal — 14-day cooling-off

Under EU Directive 2011/83/EU, consumers in the EU have a 14-day right to withdraw from a distance contract. Because credits are digital content delivered immediately, this right works as follows:

  • Unused credits bought in the last 14 days: full refund on request. Email us and we’ll process it within a few business days.
  • Used credits (a card already identified or graded): non-refundable. The directive treats each scan as consumption of the digital service, and by performing the scan you confirm you wish performance to begin and waive the withdrawal right for the consumed portion.
  • Subscriptions: you can cancel at any time. We don’t pro-rate refunds for the current billing period after credits have been used; any unused credits remain spendable until the period ends. If you cancel within the first 14 days and haven’t used any of the period’s credits, you can request a full refund.

Refunds we issue automatically

We refund credits without you asking when:

  • A scan completely fails (no card identified) — the deposit is refunded immediately.
  • A multi-card scan partially identifies — you only pay for the cards we successfully recognised.

For anything else (wrong card matched, low-quality photo we should have rejected, billing oddities), email us and we’ll look at it case by case. We’d much rather make you whole than fight about €0.50.

Chargebacks and disputes

If something looks wrong on your bank statement, please email us first. A direct refund from us is faster than a chargeback (no waiting for the bank), and chargebacks cost us a fixed dispute fee regardless of who is right.

Acceptable use

tcg-bay is for personal collection and small-scale reseller use. Please don’t:

  • Scrape the site or hammer the API in ways the UI can’t produce.
  • Resell or republish our identification or grading results as a service of your own.
  • Try to circumvent rate limits, credit deductions, or authentication.
  • Upload images that aren’t Pokémon cards in good faith (CSAM, malware, anything illegal — we will report and cooperate with authorities).

We can suspend accounts that abuse the service. We’ll refund unused credits if we suspend you for our convenience, but not for a clear ToS breach.

Beta status — no SLA

tcg-bay is in beta. Features may change, break, or disappear with short notice. We don’t commit to an uptime SLA, response time, or backwards compatibility of credits with future tier structures. We will give 30 days’ notice for material changes that affect what you’ve already paid for.

Limitation of liability

To the maximum extent permitted by law, our total liability to you for anything related to tcg-bay is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for consequential, incidental, or indirect damages — including but not limited to lost profits, sales you didn’t make because a card was misidentified, or graders who disagree with our HQ subgrades.

Nothing in these Terms excludes liability that cannot be excluded under Belgian or EU consumer law (statutory consumer rights, fraud, gross negligence, death or personal injury).

Changes to these Terms

When we change these Terms in a way that materially affects you, we bump the version above and email subscribers at least 30 days before the change takes effect. Older versions are kept on request.

Governing law and jurisdiction

These Terms are governed by Belgian law. Disputes that cannot be resolved through the channels above fall under the exclusive jurisdiction of the courts of the judicial district where Lefief CommV is registered, except where mandatory consumer protection law gives you the right to file in your own jurisdiction.
